Preamble and acceptance

These Terms of Use and Sale ("Terms") govern access to and use of the War Machines Marketplace Véhicules militaires website, published by SARL ELM (see our Legal Notice). Browsing the site, posting a listing or contacting a seller implies full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not use the site.

Purpose of the site

War Machines Marketplace Véhicules militaires is an online classifieds platform allowing individuals and professionals to post, browse and exchange listings relating to Second World War military vehicles, spare parts, equipment and accessories. The site does not itself buy or sell any goods: it solely connects sellers and buyers.

Role of the platform

In accordance with Article L.111-7 of the French Consumer Code governing online platform operators, War Machines Marketplace Véhicules militaires acts solely as a technical intermediary connecting users. War Machines Marketplace Véhicules militaires is not a party to any transaction concluded between a seller and a buyer, does not take part in the negotiation, payment or delivery of goods, and does not receive any commission on sales made between users. Every transaction takes place directly between users, under their sole and entire responsibility.

Posting listings and responsibility for content

Anyone posting a listing warrants that they own the item offered or are entitled to sell it, and undertakes to provide accurate, truthful and up-to-date information (description, condition, price, photographs, origin). It is strictly forbidden to publish false or misleading information likely to mislead the buyer as to the nature, condition, compliance or provenance of the item. War Machines Marketplace Véhicules militaires does not systematically verify the accuracy of information published by users and cannot be held liable for inaccuracies, omissions or errors contained in a listing.

Prohibited items and content

The following are strictly prohibited on the site: functional firearms and regulated-category weapons (except deactivated/neutralised items in accordance with applicable regulations, with supporting documentation available on request), live ammunition, explosives, hazardous substances, and any object, symbol or content whose possession, sale or distribution is prohibited or regulated under French and European law, in particular objects and symbols of a racist nature or glorifying war crimes or totalitarian regimes. War Machines Marketplace Véhicules militaires reserves the right to refuse, edit or remove, without notice or justification, any listing that does not comply with these rules or is deemed contrary to the law, public order or public decency.

Transactions between users

Payment, delivery, in-person handover, warranty and, where applicable, withdrawal terms are exclusively a matter of agreement between the seller and the buyer. War Machines Marketplace Véhicules militaires recommends that users exercise the utmost caution (verifying the other party's identity and the item before making any payment, favouring in-person handover or secure payment methods) and disclaims all liability in the event of a dispute, non-conformity of the item, non-payment, fraud, or any harm resulting from a transaction between users.

Moderation and removal of content

Every listing submitted is subject to review before publication. War Machines Marketplace Véhicules militaires reserves a discretionary right of moderation: refusal, editing or removal of any listing or content, including after publication, without any obligation to justify the decision, in particular in the event of a breach of these Terms, a report by another user, or a request from a competent authority.

Paid options

Posting a listing is free. Optional paid add-ons (extra photos, homepage featuring) may be purchased at the time of posting, paid by card via a secure payment provider. These options relate solely to the listing's visibility on the site and do not in any way guarantee a sale. Payment for an add-on is never a condition for the listing itself entering moderation, which always remains free. Amounts paid for a visibility add-on are non-refundable once the add-on has been activated, except in the event of a technical error attributable to the site.

Intellectual property

All elements of the War Machines Marketplace Véhicules militaires website (structure, visual identity, logo, text, code) are protected by intellectual property law and may not be reproduced without prior written authorisation. Photographs, text and other material provided by users as part of their listings remain their property; by publishing them on the site, the user warrants that they hold the necessary rights and grants War Machines Marketplace Véhicules militaires a right to display and distribute this content on the site and its communication channels, for the purposes of the service.

Limitation of liability

To the extent permitted by law, War Machines Marketplace Véhicules militaires shall not be held liable for direct or indirect damages (financial loss, non-material harm, loss of opportunity, dispute between users, etc.) resulting from use of the site, the content of a listing, a transaction between users, a temporary interruption or malfunction of the site, or a fraudulent act committed by a user. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent French courts shall have exclusive jurisdiction, subject to the mandatory rules applicable to consumers regarding competent jurisdiction.

Amendments to these Terms

War Machines Marketplace Véhicules militaires reserves the right to amend these Terms at any time, in particular to adapt them to changes in the site or in applicable regulations. The version in force is the one published on the site at the date of consultation or of posting a listing.
